WEDDING HIRE TERMS AND CONDITIONS

1. Interpretation 

1.1. In these terms and conditions, unless the context otherwise requires:

1.2. “The Business” means Mr. Fierze A.B.N. 45 996 835 643, which shall include any or all companies related or any subsidiaries and assigns of Mr. Fierze.

1.3. “The Client” means a person (including their successors, representatives and permitted assignees) hiring the Garment and where there is more than one Client, the covenants on their part contained herein shall be deemed joint and several covenants.

1.4. “The Garment” means all or any suits or suit accessory goods of any kind hired by the Client from the business.

1.5. “The Hire Terms & Conditions (T&C)” means the contract between the Business and the Client and includes the hire of the Garment. The Hire T&C starts when the Client signs the Garment Hire Agreement for the Garment, which is provided with an invoice from the Business and is fulfilled by the Client returning the Garment to the Business.

1.6. This Garment Hire Agreement is entered into between the Client and The Business, in accordance with the Australian Consumer Laws and The Privacy Act 1988 (Cth), for the hire of garments and accessories.

2.1. This Garment Hire Agreement is entered into between the Client and The Business, in accordance with the Australian Consumer Laws, for the hire of garments and accessories. The Client acknowledges and agrees to the following terms and conditions:


3. Client Responsibility:

3.1. While we make efforts to elucidate the terms and conditions to Clients, it is ultimately the responsibility of the Clients to diligently read, comprehend, and acknowledge the contents of these terms and conditions.


4. Identification:

4.1. The Business requires the Client to provide a hard/ electronic copy of their identification with a valid driver's licence and a valid credit card. The Customer agrees for the business to photocopy their identification to be stored within the Business for the duration of the Client’s hire and is destroyed once the T&C has been fulfilled and the Garment has been returned to the business on time, safe and with no damage. This is part of the hiring process and is non-negotiable. Failure to do so will result in the hire being refused.


5. Client's Warranties:

5.1. The Client warrants that all information provided to The Business is true and accurate.


6. Seek Clarifications:

6.1. In case Clients have any queries or concerns regarding the terms and conditions, they are encouraged to seek clarification from our authorised representatives before proceeding with our services.


7. Client’s Duty of Care:

7.1. The Client accepts full responsibility for the care of the garment from the time of pick up until the goods are returned to the store.

7.2. If the garment and/or goods are lost, stolen, altered, tampered with, or damaged in any way, the Client will be charged for the cost of replacement fees, at the discretion of The Business.

7.3. The accompanying Suit Bag and Hanger must be returned, or a penalty will apply, including Hanger Replacement ($2.50) and Suit Bag Replacement ($8.00).

7.4. The Business reserves the right to charge the provided identification and payment details if the suit bags, hangers, garments, and/or accessories have been lost, stolen, tampered with, damaged, or altered. This will be done if there is no communication/ replies from the Client.


8. Hire Returns:

8.1. All garments are hired from the time of pick-up until the stated return date, as noted on the invoice.

8.2. The Client must return all garments and accessories by the return date during business hours, either in person or via delivery. Delivery return costs are the Client’s responsibility.

8.3. If additional days are required, Extra Day Fees will apply. The Client must notify the Business of any delays beyond their control. Forgetting the return date or failing to return items on time without a valid reason will result in charges to the card on file. 8.3.1. $100.00 per day for a Small Wedding Group (1 - 4 Groomsmen)

8.3.2. $150.00 per day for a Medium Wedding Group (5 - 8 Groomsmen)

8.3.3. $200.00 per day for a Large Wedding Group (9+ Groomsmen)

8.4. For wedding hires, the Client is responsible for ensuring all groomsmen return their garments and accessories on time. The Client is liable for any late fees, damages, or losses.


9. Personal Belongings:

9.1. The Business will not be held responsible for any personal items left in the garments upon their return. It is the Client's sole responsibility to ensure that all personal belongings are removed from the garments before returning them to The Business.

9.2. Any items found will be held for a maximum of 30 days, after which The Business reserves the right to dispose of them.

9.3. If the Client believes they have inadvertently returned personal items with the garments, they must contact The Business via email or phone, and provide all relevant details to help identify the items.

9.4. While The Business may attempt to locate and return such items upon request, it is under no obligation to do so. If located, the items will be shipped back to the Client at the provided address, with the associated shipping costs charged to the Client’s credit card on file.

9.5. The Business assumes no liability for any personal items that are lost or damaged during transit.


10. Late Penalty:

10.1. All late returns after the specified time will be charged for the hire price of the suit per late day.

10.2. Late fees vary depending on the type of outfit and are charged as follows: 10.2.1. Black Tie Tuxedo and Other Suits: $40.00 per day

10.2.2. Full Statement Garment Looks: $50.00 per day.

10.2.3. Smart Casual Looks: $30.00 per day

10.2.4. Jacket only or Trouser only: $25 per day

10.2.5. Accessories: $10.00 per day 

10.3. If the Client fails to return the accessories on the return date, the Client reserves the right for the Business to charge a Late Accessories Return fee.

10.4. If the Client fails to return the garment within 10 days of the return date, the Client shall immediately become liable for the replacement value of each garment and accessories at the recommended retail price (RRP) PLUS late fee owing.

10.5. The Client has 3 days to pay the Replacement Fee PLUS Late Fees after the 10-day mark. If payment is not received, the Client’s file, containing the photocopies of the payment card and driver's licence, will be passed on to Debt Collectors and Legal Team.

10.6. Any legal proceedings and/or other actions taken to obtain the goods shall be at the cost of the Client.

10.7. If the Client is physically unable to return the garment in-store, it is their duty to arrange an alternative method of return and communicate this to The Business.


11. Penalties:

11.1. Failure to return the suit within 10 days of the return date and failure to communicate with The Business will result in charges.

11.2. The Business reserves the right to charge the client, with or without notifying the client, the RRP of each missing item/s, plus the total amount of late days.

11.3. The Business has the right to charge the client for legal proceeding fees and collection agency fees if the suit is to be returned within 10 days.

11.4. Should the garment and accessories get stolen or lost, the Client must pay the RRP of each item/s that was not returned to the Business.


12. Holding a Garment:

12.1. The Business requires full payment to reserve each garment.

12.2. Partial payment will not reserve the garment, and a groomsmen fitting will not proceed.

12.3. Quotes sent to the Client will not guarantee garment and/or accessories reservation.


13. Social Media:

13.1. The Business may use images taken in-store or photos sent from The Client for social media content purposes upon consent. If the Client does not wish their images to be posted, they must specify this to their stylist.

13.2. The Client reserves the right for The Business to use the images for social media and marketing materials when supplied by The Client.


14. Suit Quantity Confirmation:

14.1. The Client must reserve a specific number of suits before the second fitting. It is required that the Client completes a full payment to secure the chosen suit looks and quantity. 14.1.1. Should the Client fail to notify The Business, The Business reserves the right to withhold and postpone the fitting appointment if the number of groomsmen exceeds the initially anticipated count.

14.2. The Client is responsible for notifying The Business about any additional groomsmen and/or other family members requiring a suit hire before the groomsmen fitting.

14.3. Payment for additional suits must be made in advance for the fitting to continue.

14.4. The Business reserves the right to postpone the fitting if the payment has not been made.


15. Consolidated Payment:

15.1. The Client is responsible for making a single transaction to cover the hiring cost of all the groomsmen's suits.


16. Communication:

16.1. Effective communication between the Client and the Business is essential to ensure a seamless suit-hire process.

16.2. It is the duty of the Client to confirm with the business of any changes, additions, or adjustments.

16.3. It is up to the discretion of the Business to proceed with any written and confirmed notices made by the Client and the Business.

16.4. Any phone communications will be noted and written down by the Business and promptly emailed to the Client for confirmation.


17. Fitting Appointments:

17.1. Fitting appointments are to be scheduled in advance, with all the groomsmen to be fitted at least 2 months before the wedding.

17.2. The Client and all groomsmen must be available for fittings at the designated times made by the Groom. 17.2.1. Should the groomsmen be outside of Sydney or overseas, they can send in their measurements, which is a Remote Service Fitting Fee - refer to Section 18.3 

18. Refunds and Cancellation Fee - Single Suit hire:

18.1. All cancellation fees are in place to account for the time, labour, and resources allocated to fittings, alterations, and suit reservations. By proceeding with the booking, the Client acknowledges and agrees to these terms.

18.2. Should the Client request to cancel the suit hire within 24 hours of placing the reservation, a full refund will be issued.

18.3. Should the Client request to cancel the suit hire after the 24-hour cooling-off period, a cancellation fee of $40.00.

18.4. Should the client fail to pick up their order, before the event date and thereafter the event date, an administration cancellation fee of $100.00 is applied, plus Alterations Fees are applicable

18.5. The client reserves the right for The Business to assess all refund and cancellation fees on a case-by-case basis, taking into account the specific circumstances of each situation.


19. Refunds and Cancellation Fee - Wedding Group Suit hire:

19.1. Should the Client request to cancel the suit hire within 24 hours of placing the reservation, a full refund will be issued.

19.2. Should the Client request to cancel the suit hire after the 24-hour cooling-off period, a cancellation fee of $45.00 per person applies, plus any applicable Remote Fitting Fees.

19.3. Should the Client request to cancel the suit hire within 7-days of the event, a cancellation fee of $70.00 per person applies, plus any applicable Remote Fitting Fees.

19.4. For all cancellations made beyond the 24-hour cooling-off period, the following cancellation fees will apply based on the number of days remaining before the wedding date: 19.4.1. For cancellations made 90 days before the wedding date, a cancellation fee of $60.00 per person applies, plus any applicable Remote Fitting Fees.

19.4.2. For cancellations made 45 days before the wedding date, a cancellation fee of $65.00 per person applies, plus any applicable Remote Fitting Fees.

19.4.3. For cancellations made 30 days before the wedding date, a cancellation fee of $80.00 per person applies, plus any applicable Remote Fitting Fees and Alteration Fees.

19.4.4. For cancellations made 15 days before the wedding date, a cancellation fee of $95.00 per person applies, plus any applicable Remote Fitting Fees and Alteration Fees.

19.5. These same cancellation terms apply whether the cancellation relates to an individual suit hire (including the groom) or a group booking (including groomsmen), depending on the timing and stage of the fitting process.

19.6. If the Client requests to cancel a group booking (groom and/or groomsmen) before groomsmen fittings have commenced, the applicable cancellation fee will depend on the timing, as outlined above.

19.7. If the Client requests to cancel a group booking after groomsmen fittings have commenced, the applicable cancellation fees and associated Remote Fitting and Alteration Fees will also apply as above.

19.8. Please refer to Sections 19.2 to 19.6 for further detail on group and groom-only cancellation provisions.


20. Dry Cleaning/Damages:

20.1. The total price of the garment hire is inclusive of a dry-cleaning fee.

20.2. The Client is not permitted to send the garment off for self-dry cleaning, alterations, or any related services. Doing so will mean that the garment has been illegally tampered with.

20.3. Additional charges will apply for extra stains or damages to the suit.

20.4. If the suit/s and/or accessories are deemed non-repairable, the client will be charged the full RRP per damaged item. 20.4.1. Should the designer bow tie/s (Tom Ford, Gucci and Le Noeud Papillon) be untied, during the hire period, the Client will be charged RRP.

20.5. The Client gives permission to The Business to charge the credit card if payments for damages are not processed on time.

21. Defects:

21.1. The Client must notify The Business within 24 hours of the pick-up time of any alleged damage, defect, or non-compliance with the ordered garments via email or phone.

21.2. If the Client notifies The Business more than 24 hours after the pick-up time, it will be assumed that the alleged damage or defect was caused by The Client or within their care. This will accrue relevant fees - please see Section 7.


22. Garment Fit, Alterations Services and Remote Fitting:

22.1. Alteration services are available for groomsmen suits. 22.1.1. Any alterations and remote fitting services requested by the Client must be communicated to the Business.

22.1.2. Any alterations needed, an invoice will be supplied to the Groom, and the Client reserves the right for the business to complete the transaction with the provided identification details or complete the transaction via email or over the phone.

22.1.3. Payment is made by the Client after the second fitting has concluded.

22.2. It is the duty of the Client to ensure that all their groomsmen fit within our size ranges.

22.3. Should a groomsman/s be out of Sydney, they must send their measurements to The Business and a Remote Fitting Fee of $15.00 per suit is to be charged on the day of the pick up.

22.4. Remote Fitting fees are only applied should the groomsmen are not able to come in for a fitting. 22.4.1. Should the groomsmen not fit within our size ranges, the Client can request a suit cancellation fee for that groomsmen/s - refer to Section 19.4

22.5. The Business will ensure to measure the provided measurements by the Client and will supply the recommended ‘one-size up’ suit–unless strictly requested to go with the provided accurate measurements.

22.6. The client reserves the right to charge their supplied payment card for applicable Alterations and/or Remote Fitting fees.

22.7. The only alteration services provided on hired garments are the temporary hemming of jacket sleeve lengths and pants leg lengths. The Business does not offer any other alterations on the garment. The Business will work to have the garments be as best fitting on the client’s body as possible only if the client’s body is average-sized. 22.7.1. When a Client and/or groomsmen is deemed to have a non-average build/ body proportion, the client must understand that hired suits will have limitations in their fit, which will be explained by the Style Consultant.

22.8. Any further alterations needed can be done to a garment if it is bought.

22.9. Alterations and Remote Fitting services are charged at the specified rate. Please see Section 18.3 for measurements.

22.10. Temporary stitching for alterations may be visible at the hem of the pants, which will be removed after the hire.

22.11. Shorter persons may experience a folded hem at the bottom of the pants, causing the fabric to sit heavier.

22.12. Alterations are charged at an express rate for next-day hires (within a 24 hour period) 22.12.1. Express Jacket Sleeve Alteration Shorten / Lengthen: $35.00 / $40.00

22.12.2. Express Pants Hem Alteration Shorten / Lengthen: $30.00 / $35.00

22.12.3. Alteration refunds will not be provided after the suit has been altered.

 

23. Privacy: 

23.1. The Business treats all collected and photocopy data with the utmost confidence and complies with Australian Consumer Laws. Personal information will not be shared with any third-party companies, except as required for late/replacement purposes - please refer to section 9.5.

23.2. The Business adheres to the Australian Privacy Principles (APP1, APP3, APP6, APP11) of The Privacy Act 1988 (Cth)


24. Acceptance of Terms:

24.1. By proceeding with the wedding suit hire, the Client acknowledges the understanding and agreement with these terms and conditions.

24.2. The Goom accepts the responsibility for adhering to the terms on behalf of all their groomsmen.


25. Purchase as Acknowledgement:

25.1. Purchasing a garment along with proof of purchase signifies agreement with the terms and conditions.
